An Akron man was sentenced to two years of community control Feb. 6, after he pleaded guilty to felony drug charges in connection with his arrest by Cuyahoga Falls Police last summer.
Kevin A. Smith, 42, received the sentence from Summit County Common Pleas Court Judge Thomas Teodosio, according to April Wiesner, director of communications for Summit County Prosecutor Sherri Bevan Walsh. Wiesner added that Smith also had his driver's license suspended for 12 months and has to be screened for drug addiction and treatment.
"I thought it was a fair and equitable sentence by the court," said Smith's attorney, Leonard J. Breiding II.
On Nov. 26, 2012, Smith pleaded guilty to illegal assembly or possession of chemicals for the manufacture of drugs, a third-degree felony; aggravated possession of drugs, and possessing criminal tools, both fifth-degree felonies. Two counts of illegal manufacture of drugs were dismissed, according to court records.
Smith, along with Nathan E. Ketterman III, 31, also of Akron, were arrested by Cuyahoga Falls Police on Aug. 16, 2012, after law enforcement officials served a search warrant in a raid of a Northampton Road home. Members of the Cuyahoga Falls Police narcotics unit had developed information indicating the residence was being used in the manufacture of methamphetamine, according to a Falls Police news release.
Ketterman is charged with: illegal manufacture of drugs, a first-degree felony; illegal manufacture of drugs, a second-degree felony; illegal assembly of chemicals for the manufacture of methamphetamine, a third-degree felony; aggravated possession of drugs and possession of criminal tools, both fifth-degree felonies, according to Wiesner.
A warrant is out for Ketterman's arrest after he violated a condition of his release, according to court records. The warrant was issued Dec. 3, 2012. A trial was set to begin Jan. 29, but Judge Teodosio issued an order on Feb. 5 terminating the case from the pending cases "by reason of unavailability for trial," according to court records.
